General terms and conditions of online sale jennirose.ch March 2020

I. General
The Jennirose Terms and Conditions govern the contractual relationship between the Jennirose.ch online store and the client (hereinafter referred to as "the client") using the latter's services. They apply exclusively and as it should to all orders placed on Jennirose.ch.
Jennirose's offer includes some of the creations available in the showroom. Only a few items can be exclusively distributed in so-called partner stores directly like NOA, ZAZAZOU AND RUSH & CO.
Jennirose's product offers are only valid as long as they are visible on the site and within the limit of stocks available in showrooms and shops.
The photos appear on Jennirose for illustration only and are not contractual.
II. Guarantees
Jennirose provides the customer with items that have been checked and provided with labels upon receipt explaining that they are handmade and therefore crafted. The customer must examine the goods upon receipt. Any defects or delivery errors must be reported to contact@jennirose.ch immediately, or at the latest within 7 days after receipt of the goods (or, in the case of hidden defects, since the discovery of the defect), in writing and in detail. In the event of late notification of defects, the goods are deemed to be accepted and all guarantees become void.
When notice of defects is received in time, defective goods must be returned to Jennirose | Online Shop | 25 Grand-Rue | CH 1204 Geneva, in their original packaging and in the package used for shipping. If the complaint is justified, the defect is remedied, at the choice of Jennirose.ch, by repairing the defect, delivering non-defective goods or possibly reimbursing defective items.
You can also go to the showroom directly to have the fault examined.
Postal parcels and packaging can be reused during returns and exchanges if they are still in good condition.
III. Registrations and account
In order to use certain services offered by Jennirose, in particular to make a first purchase on Jennirose.ch, the customer must create an account that he can modify or delete at any time on the site. Personal information must be entered accurately.
Following registration, the customer receives a confirmation e-mail. To access "My Account", the customer must identify himself using his e-mail address and password. In this space, the customer finds all the personal data entered during registration and their order history. He can also fill in the data on the site, allowing him interesting offers.
Orders from consumers residing in Switzerland and abroad can be placed.
IV. Orders
1. PLACING AN ORDER
Purchases on the Jennirose.ch site are exclusively reserved for customers who have correctly registered and provided accurate information.
After selecting the size, color and quantity of the desired product (s), the customer must add the article to "My basket". After having checked and accepted the general conditions, the data protection declaration and the provisions of the right of withdrawal (7 days), the customer must select the desired method of payment and click on the "Send order" option.
After each order, the customer receives a confirmation e-mail from Jennirose.ch. Once the confirmation email has been sent, the order becomes effective.
However, an order is only final after acceptance by Jennirose.ch.
The customer cannot modify or cancel an order from his customer account.

Any use of the site for professional or commercial purposes, to resell the articles to third parties, is strictly prohibited. In the event of an infraction, the client is exposed to immediate exclusion and may be sued by Jennirose for damages.
In certain exceptional cases, Jennirose may limit the maximum deliverable quantity per article and per customer.
Jennirose reserves the right to accept any order placed on www.jennirose.ch
2. AVAILABILITY OF ITEMS
Despite all the precautions that Jennirose.ch takes to have the most precise information possible regarding the availability of the items offered, it may happen that one or more of them, deemed to be available at the time of the order is (are) finally unavailable. In the event of unavailability of one or more articles which constitute the order, Jennirose.ch will, in fact, be obliged to proceed to the partial or total cancellation of the latter.
V. Price
The prices on Jennirose.ch are indicated in Swiss francs on the page in French version and in euros on the page in English version and payable exclusively in Swiss francs on both.
They include VAT. The same goes for the prices indicated benefiting from a discount.
Jennirose.ch reserves the right to modify its prices at any time.
The prices charged in stores and on the online store are the same.
However, promotional actions can take place exclusively on Jennirose.ch.
The prices invoiced to the customer for the products delivered are those in force on the date of the order and which appear on the order confirmation.
The packaging and shipping costs are borne by Jennirose.ch and are not invoiced to the customer. Exceptions are expressly specified.
VI. Payment terms
Jennirose.ch offers the following payment methods: PayPal, credit/debit cards and Twint.
A. Payments
1. CARD PAYMENT
The customer can pay for the items by credit card. All payment transactions are made in a secure area, in application of the highest security standard (https: //).
We use totally secure methods of transmission and encrypted payments with our payment partners.
In addition, Jennirose.ch does not store any information relating to your payment.
The transaction is only debited from the customer's credit card when the order is confirmed, once the information on the credit card has been verified, the withdrawal authorization sent by the company which issued the card. credit used by the customer issued and the order confirmed by Jennirose.ch.
VII. Delivery
Jennirose makes deliveries in Switzerland and Europe. For reasons related to the COVID-19 health crisis, delivery is offered in Switzerland and Europe. For other countries the delivery rates will be borne by the customer. Delivery is made within 1 to 5 working days from receipt of the order.
Any claim for damages due to late delivery is excluded.
VIII. Right of return | Returns
The customer has the possibility of returning the unworn articles within 10 days from the date of invoicing, indicated on the invoice slipped in the parcel, by post or to bring them directly in showroom.
Beyond this date, we will not be able to accept returns.
By mail
Returns by parcel must be made with the return slip with a number which will be included in the parcel when it is sent. In order to facilitate the processing of returned items and to proceed with a refund, the delivery package must include this return slip.
The return address is indicated on the pre-printed adhesive label.
The customer must indicate his name, first name and address in the space provided for this purpose.
Upon receipt of the products, the Jennirose team will carry out a quality control.
The articles must, without exception, be new, not have been worn or washed, be intact and in their original condition (with their label (s)). Otherwise, Jennirose reserves the right not to accept returned items or to request compensation.
Return by post is the responsibility of the customer who also bears the risk of sending.
In case of return of an item paid for by means of a gift card, a new gift card is issued and sent to the customer by e-mail.
At the showroom
Returns are accepted and free. The customer must imperatively present himself at the showroom with the invoice appearing in the parcel upon delivery.
The invoice can also be printed from the customer's Jennirose online account, in the "My orders" section. The teams will then carry out a quality control.

IX. Refund
If all the conditions described above are met, the return may be subject to a refund (or an exchange, at the showroom and on Jennirose.ch while stocks last).
Reimbursement is made in the same payment method as that selected when ordering, instantly at the showroom and upon receipt of the goods in the event of return by La Poste.
Credit card reimbursement is possible at the showroom, provided that it is made on the same card as that used when ordering. Unfortunately, it is not possible to take account of fluctuating exchange rates in this case.
Reimbursement may also be made in the form of an exchange check.
Refunds on gift cards are instant in the showroom. In the case of a return by Poste, a gift card is sent by email on the day of receipt.
X. Retention of title
The ordered articles remain, until their complete payment, the property of Jennirose.
The brand can, in the event of default of payment and even if the articles have already been delivered, request their return in their original state. Jennirose reserves the right to initiate any action for damages.
XI. Product quality
Jennirose.ch offers unique creations made by hand by professional dressmakers. Jennirose guarantees the authenticity of all products sold on Jennirose.ch. The products in the range benefit from the highest levels of quality in terms of materials used, design and finish.
All products have been produced in the stylist's affiliated workshops.
If the customer wishes to bring a complaint to the attention of Jennirose.ch, he can contact customer service (Monday to Friday, 8:00 a.m. to 12:00 p.m. and 1:00 p.m. to 5:00 p.m.) at the following address:

XII. Differences
The articles sold on Jennirose.ch correspond to real products, presented in the form of a digital photograph. There may therefore be minor differences between the photo and reality, but they do not in any way constitute a defect.
XIII. Data protection and personal information
The protection of data and the privacy of our customers is very important to us. The Jennirose.ch account information is used exclusively for the commercial relationship between the client and Jennirose. This information is never shared with third parties or sold.
Jennirose respects the code of ethics for distance commerce of the ASVPC (Swiss Mail Order Association).
The customer's bank information is never in our possession since the bank transactions are carried out directly and completely securely by our payment partners. Jennirose only keeps the information it needs for customer service.
To create a customer account, the customer must provide personal information concerning him on Jennirose.ch. These include his gender, first name, last name, e-mail address, language in which he wishes to communicate, date of birth, address and telephone number. The information marked with an asterisk is mandatory for order processing. Without this information, Jennirose.ch cannot process orders.
Jennirose does not communicate this information to third parties, with the exception of its service provider partners. They only need this information for order processing, payments, deliveries, credit checks or to perform statistical analysis. They are not allowed to use them for their own benefit. These communications of information are therefore reduced to the strict minimum.
Jennirose.ch uses permanent cookies. They are simply used to record the customer's transactions, to facilitate his future visits to our site and his future orders and to adapt the offer as best as possible to his tastes. It is possible to allow cookies in the security settings of the web browser used.
Jennirose uses the user's data via Google Analytics anonymously to obtain analyzes on the use of Jennirose.ch. Google Analytics is only used for internal Jennirose market research, to adapt the organization of Jennirose.ch to customer needs.
All personal information recorded on the site (address, purchases) is treated as strictly confidential. At any time, the customer can modify or delete his personal information in the "My account" section then "My personal information".
XIV. Modifications
Jennirose reserves the right to modify these general conditions of sale. As such, the date of their last modification is always indicated. Version 2.2: 20.03.2020.
The conditions of access to this website are subject to the provisions of Swiss regulations and must be interpreted in accordance with Swiss law.
XV. Law | Jurisdiction
These general terms and conditions of online sale are subject to Swiss law, as well as all the processes and transactions that are subject to it.
For all relative litigation, the competent jurisdiction is that of the domicile of the client if he is a defendant; if the client is a claimant, he may choose to file an action with the Geneva courts (Jennirose headquarters).
